KICA Board to Host Special Meeting Amending Capt. Sam’s Agreement and Finalizing Deed for 54+ Acres of Beachfront

UPDATE (Sunday, March 10): The board’s special meeting has been canceled.

On Feb. 1, we announced that Kiawah Partners had agreed to convey by quit-claim deed the non-buildable land at Captain Sam’s Spit, as stated in the Amended and Restated Development Agreement, to the community association to hold in common for the benefit of the membership.

The board has called a special meeting for Monday, March 11 at 8:30 a.m. to finalize agreements. The public, virtual-only meeting will include two votes: a revision to the agreement (initiated by KICA) to clarify the pending marshland conveyance and approval of the quit-claim deed for the beachfront land on the spit, which will then be placed into escrow.

 

A NECESSARY CHANGE FOR A TIMELY TRANSFER

The spit is comprised of land that is prone to shifting as sand accretes and erodes on either side. At the time of the agreement, neither party could be certain of the actual size of the land conveyance that would be taking place. Kiawah Partners contracted for survey work to be completed.

The agreement breaks the conveyance into two: one for the beachfront acres (the deed is intended to be voted on at Monday’s special meeting) and one for the riverside marshlands. The survey for the marshlands still requires review by OCRM (Ocean & Coastal Resource Management), the South Carolina government agency that must certify the location of the critical line. Once this process is completed, the deed of conveyance will be finalized and placed into escrow for the marshland area.

 

A KEY STEP IN THE RIGHT DIRECTION

The board is proud to have reached this agreement with the Partners, and to have secured this unique land for the members. While this agreement quickly solidifies community ownership of parts of the spit, it does not involve the remaining highland area.

With this pending conveyance, KICA and, by extension, KICA members will be key stewards of this pristine and substantial habitat and play an essential role in determining its future.
