Progress Report from the Legal Committee of the Board
Dear members,
The KICA Board of Directors formed a legal committee in response to a March 26, 2023, demand letter from four members of the association related to the master developer’s seat on the KICA Board and various questions regarding the Architectural Review Board (ARB). KICA has sought the advice of outside legal counsel on this matter.
As a result of that advice, two representatives of the legal committee met with representatives of the master developer, Kiawah Partners, on July 18, 2023, to open a dialogue to determine if the parties could work together to resolve the issues before resorting to time consuming, costly litigation. The meeting with representatives of Kiawah Partners was amicable and productive so further meetings are anticipated.
Counsel for the legal committee notified counsel for the four association members of its progress on responding to the letter via the enclosed letter. The legal committee will continue its dialogue with the master developer for the time being and will update the membership as discussions progress.
