Statement from the KICA Board of Directors: ARB Payments

At the March 2023 meeting of the KICA board, the directors asked for their legal counsel to review the previously made ARB payments (2008-2022) and whether there are steps that could be taken to request a refund of these payments. The board received an opinion from its legal counsel and discussed this at their May 2023 executive session, without the developer director present. The non-conflicted board members unanimously agreed that the board will not be taking any further steps to pursue the recovery of these payments.

As a reminder, the KICA board suspended payments to the ARB in December 2022. In May 2023, they took the additional step to remove this line item from the 2023 budget.
